Terms of Service

These Terms of Service ("Terms") govern your access to and use of avoce.ai and the Avoce live captioning and translation service (the "Service"), operated by Avoce ("we", "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Avoce captures spoken audio in your browser and produces live captions, with optional real-time translation, and lets you export the resulting transcript. Recognition and translation are automated and may contain errors.

2. Your account

You can sign in with your email (via a one-time code) or with Google. You are responsible for keeping access to your email and account secure, and for activity that occurs under your account. Provide accurate information and keep it up to date.

3. Points, payments, and refunds

The Service runs on points (credits), used on a pay-as-you-go basis. Points are consumed based on your usage and the mode you choose.

New accounts may receive trial points. Trial points have no cash value and may expire or change.

You can purchase additional points through Stripe. Prices are shown at checkout.

If a purchase is refunded, the corresponding points are removed from your balance. Points are not redeemable for cash and are non-transferable.

4. Acceptable use

You agree to use the Service lawfully and to obtain any consent required to capture, transcribe, or translate other people's speech. You must not use the Service to infringe others' rights, to capture audio you are not permitted to record, or for any unlawful, harmful, or abusive purpose. You must not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

5. Your content

You retain ownership of the audio you capture and the transcripts and translations you generate ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service to you (including sending it to the providers listed in our Privacy Policy). You are responsible for Your Content and for having the rights needed to use it with the Service.

6. Third-party services

The Service relies on third parties (including OpenAI, Supabase, Stripe, Vercel, and Google). Your use may also be subject to their terms, and we are not responsible for their services.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that captions or translations are accurate, complete, or suitable for any particular purpose, or that the Service will be uninterrupted or error-free. Do not rely on the Service in situations where errors could lead to harm.

8. Limitation of liability

To the maximum extent permitted by law, Avoce will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. To the extent we are found liable, our total liability is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Certain provisions (such as payment obligations, disclaimers, and limitation of liability) survive termination.

10. Changes to the Service and Terms

We may modify the Service or these Terms. If we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Taiwan (Republic of China), without regard to conflict-of-laws rules. Disputes will be subject to the competent courts located in Taiwan, unless mandatory law provides otherwise.
